If Evolution isn't real: Why are crocodiles genetically more closely related to hummingbirds than to iguanas?

Creationists often argue that similar genes are a results of a common creator - if this was the case wouldn't it be expected that crocodiles and iguanas would have the more similar genes, as they are morphologically and behaviorally similar?
